These rules and regulations shall apply to all data created, collected and processed by any college, department, division, unit, office and staff of the University of the Philippines in Diliman.
These rules and regulations shall apply to all publicly-funded UP Diliman programs and projects.
These rules and regulations shall apply to ODA-funded UP Diliman programs and projects.
* 4.4 This IRR shall apply to UP Diliman programs and projects funded by foreign governments.

Open data shall comprehend textual material such as historical, scientific, geographic, music, film, books, linguistics, bioinformatics, chemical crystallography, paleogenetics, government and other administrative information and, non-textual materials inclusive of maps, genomes, connectomes, chemical compounds, mathematical and scientific formulae and models, bioscience and biodiversity, environmental data, including computer, electronic or magnetic tape stored data.
Open data shall be drawn from any of the following data category: economics, educations, law, environment, earth, geospatial, health, infrastructure, architecture, engineering, social sciences, finance, public safety, social welfare, community development, music, statistics, and sports science. [Note: This is not an exhaustive list and will continuously be edited until the release of the final draft]
Exceptions to or inapplicability of these rules and regulations shall be treated on a case to case basis, based on specific valid reasons.
Open data may be reused with open license and without requiring prior UP permission. Appropriate acknowledgment or citation and provenance shall be given.
All data/datasets shall be made publicly available, and accessible by default, timely, with corresponding metadata with contextual information, in machine readable formats, and released with open license.
All data/datasets shall be interoperable with all government information and communications technology systems in accordance with the Philippine Electronic Government Interoperability Framework and other guidelines that shall be issued by the national government ICT Office.
These rules and regulations shall not apply to the following:
UP Diliman programs and projects which are privately-funded, national or international.
Data or metadata of UP Diliman programs and projects with restrictions due to national security (military installations and deployment), individual privacy (personal and financial status), confidentiality (test results done by UP for third parties, names of institutions collaborating work with government ), intellectual property rights (patents, trade secrets, commercial information, copyrights) and law (personal information, sensitive personal information and privileged information, among others).
Restrictions imposed by Republic Act No. 10173, otherwise the Data Privacy Act of 2012
Any Agreement of which the University of the Philippines Diliman is a signatory shall comply with these rules and regulations. In any conflict between the Agreement and these rules and regulations, the Agreement shall prevail.
